These Terms & Conditions form the agreement between Lely, Lely Farmers and Referred Farmers concerning the Lely Referral Program Pilot. To participate, Lely Farmers and Referred Farmers must agree to these Referral Terms. 

1. Definitions

Lely Farmer or Referrer means the person who is a customer of Lely and who refers a referred farmer by sending the referred farmer to the landing page https://www.lely.com/gb/refer-a-farmer/ to sign up.

Referred Farmer or Referral means the person who is referred by the Lely Farmer and has registered on https://www.lely.com/gb/refer-a-farmer/. A Referred Farmer is a person owning a farm and is not a customer of Lely yet.

Referral Terms means these Terms & Conditions, including updates, alterations and possible appendices, published on the Lely website.

We (“our”, “us”, “Lely”) means Lely International N.V., Cornelis van der Lelylaan 1, 3147 PB, Maassluis, The Netherlands. 

Website means our website: www.Lely.com.

You means the Lely Farmer and/or the Referred Farmer, as applicable.

2. Scope of Application

The Lely Referral Program allows a Lely Farmer to introduce farmer friends, family or acquaintances (‘Referred Farmer’) to Lely. After signing up on https://www.lely.com/gb/refer-a-farmer/, the Referred Farmer will be contacted by Lely regarding information about farm automation. 

By participating or attempting to participate in the Referral Program, you accept and agree that you, as a Lely Farmer or Referred Farmer, are bound by the Referral Terms.

3. Referrer

Lely offers: 

• A free gadget sent to the Lely Farmer home address upon a successful referral subscription. This means that the Referred Farmer has made a successful subscription on the website. 
• A £50 voucher will be offered to the customer per referral, upon the successful registration of the referral. A total of £150 will be offerd to the customer once three referrals have signed up successfully. This voucher can be used on Lely Consumables, Upgrades or Lely Merchandise. 
• A five hundred pounds (£500) discount on any new Consumables, Upgrades or Lely Merchandise order to Lely Farmers upon a successful referral with a Lely Astronaut or Lely Vector. This means that the Referred Farmer has purchased a Lely Astronaut or Lely Vector in a Lely Center as a result of the Refer a Farmer program. For Consumables the minimum order amount of £1000 is required.
• A one hundred pounds (£100) discount on any new Consumables, Upgrades or Lely Merchandise order to Lely Farmers upon a successful referral with a Lely Discovery or a Lely Juno. This means that the Referred Farmer has purchased a Lely Discovery or a Lely Juno in a Lely Center as a result of the Refer a Farmer program. For Consumables a minimum order amount of £1000 is required.

There is a limit of three (3) times the Lely Farmer can repeat the referral process. Only one discount code per order is allowed. 

4. Referral 

Lely offers: 

• A free gadget sent to the Referred Farmer's home address upon a successful referral subscription. This means that the Referred Farmer has made a successful subscription on the website. 
• Information about farm automation via email. 
• Possible invite for an online webinar about farm automation.  
• Contact by a local Lely Center employee to offer more information about farm automation. 
• A five hundred pounds (£500) discount on any new Consumables, Upgrades or Lely Merchandise order to Lely Farmers upon a successful referral with a Lely Astronaut or Lely Vector. This means that the Referred Farmer has purchased a Lely Astronaut or Lely Vector in a Lely Center as a result of the Refer a Farmer program. For Consumables a minimum order amount of £1000 is required.
• A one hundred pounds (£100) discount on any new Consumables, Upgrades or Lely merchandise order to Lely Farmers upon a successful referral with a Lely Discovery or a Lely Juno. This means that the Referred Farmer has purchased a Lely Discovery or a Lely Juno in a Lely Center as a result of the Refer a Farmer program. For Consumables a minimum order amount of £1000 is required.

5. Terms of Validity

The possibility for the Lely farmer to invite other farmers via email is valid from May 2021 till 6th of September.

The purchase of Lely equipment by the Referral farmer must take place during the above period.

Discount vouchers are for one-time use and expires eighteen (18) months from the date of receipt.

From May 2021 the registration links are valid for three (3) months. 

6. Privacy and Data protection

Any personal details provided in connection with the Referral Program will be processed in accordance with our Privacy Policy. It is important that you carefully read and understand this information.

All data collected by us will be used and processed exclusively within the framework of the current Dutch and European Union data protection laws and in accordance with our data protection and privacy policies.

7. Duration and Right to termination

The Referral Program runs from May 2021 until August 2022. 

Lely can terminate the Referral Program or a person’s ability to participate at any time for any reason and without notice. 

Lely reserves the right to suspend accounts, cancel the discount code or refuse a transaction if we notice any activity we believe fraudulent, improper, or unlawful or if we have a reason to assume you are in breach of these Referral Terms.

Lely reserves the right to review and investigate all referral activities and to suspend accounts or modify referrals as deemed fair and appropriate.
 
8. Limitation of liability

Lely accepts no liability for loss, theft, destruction or improper use of the discount code, unless this is the result of gross negligence on the part of Lely.

Nothing in this agreement serves to exclude or limit liability for:

• death or personal injury due to negligence;
• deliberate deception;
• any other form of liability that cannot legally be excluded or limited.

9. Governing law and jurisdiction

These Referral Terms are to be construed according to, and shall be governed by, Dutch law. The applicability of the Vienna Sales Convention (CISG, 11 April 1980) is explicitly excluded.

All disputes arising out of or in connection with these Referral Terms shall be settled by the competent court of Rotterdam, the Netherlands.

10. Changes to Terms and Conditions

Lely reserves the right to, at all times, amend these Referral Terms by publishing an amended version on the Lely Website.

You are free to decide whether or not to accept a revised version of these Referral Terms. If you do not agree to any revised version of these Referral Terms, your sole recourse is to stop your participation in the Referral Program.

Except as otherwise expressly stated by us, participation in the Referral Program is subject to, and constitutes your acceptance of, the version of these Referral Terms in effect at the time of your participation in the Referral Program.
